These Terms of Use ("Terms") govern your access to and use of the website and services (the "Services") provided by Luminux Capital ("Luminux," "we," "us," or "our"), a brand operated by LeadLaunch Media, a sole proprietorship. By accessing or using the Services, or by submitting your information through our forms, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years of age and acting on behalf of a business to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and that you are authorized to provide it.
Luminux Capital is a marketing and lead-generation service. We help connect business owners with a funding partner who may offer invoice factoring, invoice discounting, or related financing. Luminux is not a lender, bank, broker-dealer, or funding provider. We do not make credit or funding decisions, do not provide financing, do not set rates or terms, and do not fund, service, or collect on any transaction. Any financing is offered and provided solely by a third-party funding partner under that partner's own agreements.
Submitting your information does not guarantee that you will be contacted, approved, or funded. Approval, funding amounts, advance rates, timelines, confidentiality options, fees, and all other terms are determined solely by the funding partner and are subject to their review and verification. Any figures referenced on our Services (such as potential funding speed) describe possibilities offered within the industry or by our partner and are not promises of the results you will receive.
When you submit a form, you agree that your information may be shared with a funding partner who may contact you, as described in our Privacy Policy. If you provided consent to be contacted, you authorized Luminux and the funding partner(s) it identifies to contact you at the phone number and email you provided — including by automated or prerecorded call and text — about your inquiry. Consent is not a condition of any purchase, and you may opt out at any time as described in our Privacy Policy. You are responsible for the accuracy of the information you submit.
You agree not to: (a) submit false, misleading, or unauthorized information, or information belonging to another person or business without authorization; (b) use the Services for any unlawful, fraudulent, or abusive purpose; (c) attempt to interfere with, disrupt, probe, or gain unauthorized access to the Services or their systems; (d) copy, scrape, or harvest content or data from the Services; or (e) use any automated means to access the Services except as expressly permitted.
The Services, including all text, graphics, logos, design, and the "Luminux Capital" name and marks, are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to access and use the Services for their intended purpose. You may not reproduce, distribute, or create derivative works from the Services without our prior written consent.
The Services may reference or link to third parties, including funding partners and service providers. We do not control, and are not responsible for, the products, services, actions, terms, privacy practices, or communications of any third party. Any dealings you have with a funding partner — including any application, agreement, financing, or dispute — are solely between you and that partner.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SUBMISSION WILL RESULT IN CONTACT, APPROVAL, OR FUNDING.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINUX CAPITAL AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY DEALINGS WITH A FUNDING PARTNER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless Luminux Capital and its owner from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your submissions, or your violation of these Terms.
We may modify, suspend, or discontinue the Services at any time without notice. We may also update these Terms from time to time; when we do, we will revise the "Effective date" above. Your continued use of the Services after any change constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
